Montana lawmakers have tried to outright ban TikTok from the state, citing national security worries over the app’s ties to China.
The bill was approved by the Republican-controlled state House on Friday, after being approved by the Republican-controlled Senate. The bill forbids app shops from “making the TikTok application available to Montana users.”
It now goes to Republican Gov. Greg Gianforte’s desk, who has not stated whether he plans to sign it. According to his office, he would “carefully consider any bill the Legislature sends to his desk.” The bill, if signed by the governor, would take effect on January 1, 2024.

According to the bill’s text, the reason for the ban is that TikTok “gathers significant information from its users, accessing data against their will to share with the People’s Republic of China” and “fails to remove, and may even promote, dangerous content that directs minors to engage in dangerous activities.”
Republican state Sen. Shelley Vance sponsored the bill, calling TikTok “a major threat to our national security.” TikTok is owned by ByteDance, a Chinese corporation, and has been accused of providing China with access to American data.
According to a TikTok spokesperson, the prohibition would be a violation of the First Amendment and would be difficult to execute.
“We will continue to fight for TikTok users and creators in Montana whose livelihoods and First Amendment rights are threatened by this egregious government overreach,” spokeswoman Brooke Oberwetter said.
Apple and Google, for example, might risk a $10,000 per day fine if they allow the program to be downloaded from their app stores.
The ACLU and other groups have also spoken out against the prohibition, claiming that it would “trample on Montanans’ constitutional right to free speech.”
TikTok was said to be under investigation last month for potentially spying on US people. The FBI, the Department of Justice Criminal Division, the Fraud Section, and the United States Attorney for the Eastern District of Virginia launched a criminal investigation into TikTok’s suspected surveillance of American journalists.

Prosecutors have issued a subpoena to ByteDance in connection with “efforts by its employees to access U.S. journalists’ location information or other private user data using the TikTok app.”
A government ban on TikTok has been proposed, and the Biden administration has indicated that it may support such a restriction.
