Although owning a home can be quite gratifying, there can also be some significant drawbacks.
A woman in Florida just decided that it was time to find out why she was fined $165,000 for merely parking in her own driveway.
Florida may have had a higher standard of living than other locations on Earth, but it was no longer a place where one could live the American dream, not anymore at least. Well, for some people, Florida can be a paradise, but for others, it’s just tolerable and for Sandy Martinez, she had dreams of bigger things.
Cramped and cramped, with little room to move around –Sandy Martinez lived like a sardine in her apartment. Her home was an utter nightmare being too tight to fit anyone who walked in. She experienced two major problems.
First, few jobs offered wages sufficient for subsistence. Similar to many people in her area, although Sandy was not earning the wage she thought she deserved, Sandy was known for spending every single salary she received right away. She would then experience excruciating worry for the remainder of the month as a result of the enormous pile of overdue bills that hung over her.
The consequences of living paycheck to paycheck were numerous. She had to choose which bill was more crucial each month because she wasn’t always able to pay all of them.
Another problem was that it was basically impossible to purchase a home in her state. The housing market is one of the most competitive in the United States. While Sandy was fortunate to own one, it wasn’t the greatest. So she had no choice but to rent a small place for her, her mother, and her three daughters.

They purchased a second-hand car to help get them to and from work. Her daughters spent months saving every penny so that they could afford to buy a car. This meant that their driveway had four vehicles parked in it. However, it could sometimes be inconvenient to have four cars parked in a small driveway and since there were four cars and only one driveway, two of the cars would sometimes have to be parked on the lawn, with their tires approximately a foot over the pavement line. It was not a very convenient or comfortable situation, but they would soon learn that the government had its issues with the situation.
When Sandy got an unsettling letter in the mail, she could not believe what she was seeing. She stared at the paper in shock, her blood starting to boil. She apparently received a $250 fine! Because of how the cars were parked in the driveway, they really were that harsh. Her problems didn’t end there, either.
Sandy did what she could to make things right despite her rage over the fine. She requested an inspector to come and check that the family was parking properly, and she sat and waited for the inspector to arrive on her porch to check the condition of her driveway but no one ever showed up. Even after countless voicemails, no one got back to her.
She moved on with her life, assuming that the issue had been resolved. She would soon, however, regret doing that.
In the town of Lantana, the law provides that “All off-street parking spaces, including driveways but not including parking spaces located in swale areas as permitted by section 17-34, shall be asphalt, concrete or block and shall be hard-surfaced and in good repair in compliance with town codes.”
Sandy’s driveway, however, was limited in its length.
However, Sandy’s driveway was only a little distance long. Sandy carried on with her life, oblivious to the plans the city was making. But when more fines were issued against her, she was quickly brought back to reality. The city soon sent them a few more fines. One was for a section of the driveway’s fractured pavement, and the other was for a storm-damaged fence.
Sandy reasoned that it would be best to address the problems in order to prevent further fines.
She managed to wire some funds despite her restricted time so that experts could fix her fence and pavement.
Sandy thought these fines were ludicrous, but she tried to handle everything.
A few weeks later, she received another note at her door. She eagerly opened it, and the contents made her eyes well up with tears.
She was very shocked. She was unaware that she was being fined $250 a day for the driveway incident, and the city hadn’t even sent the promised inspector!
Sandy pulled out her phone to make a call to someone she felt could handle this because she and her family had lived in that house for 17 years and it was horrifying that they were now getting these expensive fines.
After learning about the Institute for Justice’s efforts to assist those who were subjected to unfair and disastrous circumstances by large government, she knew they would be the perfect fit for her predicament.
There was no way she was going to let them get away with this. Who did they think they were?
When Sandy told The Institute for Justice what had transpired, they decided they had to take up her case and that it was time to sue the Lantana authorities.
Sandy and her attorney did as much planning as they could. The fact that Sandy had asked for an inspector but never received one was simply ignored by the municipality of Lantana.
Now, the city needed her for another reason. a further $65,000 to cover the damaged fence and driveway.
Sandy was shocked because she had already paid the fine and had these problems resolved by experts.
The city did not let up, despite the fact that she had receipts and images to show that she had fixed everything.
Her lawyers weren’t going out without a fight. After a long few days of testimony, a city representative wanted to settle.
They still wanted her to pay!
It felt like getting punched in the face when the amount was reduced from a staggering $165,000 to $25,000. They thought it was “more than fair,” and Sandy didn’t need to consult her attorney. She tore up the piece of paper as she fixed her gaze on the obnoxious woman across from her.
Sandy was prepared to move on to the following stage. She and her attorney called each news organization they could think of. Additionally, they published on all social media platforms and urged users to spread her story. She was prepared when the news vans drove up.
She explained the entire event, from the initial fine to the demeaning “settlement,” while standing in front of her home.
She had no intention of giving up the struggle. They would never be able to get even a single dollar from her. And no matter how long it took, she would make sure they finally confessed they were mistaken.
Sandy sought to establish a point. She had the opinion that property should be managed by individuals free from governmental interference.
At the press conference, Sandy said, “I’ve been living her for 17 years now and I’m being fined over $160,000 for parking on my own property.”
Sandy added that she had left the town “voicemail after voicemail” asking them to send an inspector but she got tired of “playing phone tag”.
The city, however, refused to accept this as proof. Sandy then came up with a wonderful plan. It was time to present her case in court after Sandy’s story was covered by news outlets across America. All she needed was the assistance of her dependable attorney. She was able to find a record of her phone calls and provide it as proof with the aid of her attorney.
She claimed that the fines imposed on her are unlawful and asked the court to issue a declaratory ruling in favor of her complaint.
Her ultimate objective was to have these fines declared to be unconstitutional.
Sandy filed a lawsuit against the state of Florida for a number of reasons.
Many individuals all throughout the country sent Sandy a ton of support and encouragement as soon as she spoke out about her situation.
They say the best revenge is served cold. That’s exactly what Sandy did as she went directly to a superior power to overrule her own city’s decision.
For Sandy, this was a matter of principle. If people can’t be free to manage their property and practice their affairs free from government control – especially when they’re not harming anyone, then what does that say about our society?
